Section 1983 of Title 42 of the United States Code is a federal law that provides individuals with the right to sue state and local government officials who violate their constitutional rights. This law is often used in healthcare-related cases when a detainee’s or inmate’s constitutional rights were violated by a government employee or a healthcare provider. The detainee or inmate must show that the official or healthcare provider was deliberately indifferent to a serious medical need.
